Welcome to Speak Out

Speak Out provides an AI-powered language learning platform via the Speak Out mobile application (the "App") and related internet services (collectively, the "Services"). The Services are operated by Speak Out ("Company", "we", or "us") for users of the Services ("you"). This Privacy Policy describes how we collect, use, and share information when you use our Services. Under applicable law, Speak Out is the "data controller" of personal data collected through the Services.

Information We Collect

Information You Provide

We collect information you voluntarily provide when you:

  • Create an account — email address, display name, and authentication credentials (via Firebase Authentication).
  • Set up your profile — native language, target language, and proficiency level (CEFR A1–C2).
  • Use the AI tutor — voice recordings and text messages sent during real-time conversation sessions with our AI tutor. These are processed to generate responses and are stored as session transcripts.
  • Contact us — any information you include in emails or support requests.

Information Generated Through Use

As you use the Services, we generate and store:

  • Session data — transcripts, duration, AI-generated summaries, and identified language mistakes from your conversation sessions.
  • Learning memory — facts about your learning style, progress, and preferences extracted by AI from your sessions, used to personalise future tutoring.
  • Usage data — minutes used, session counts, and quota consumption for metering purposes.

Information Collected Automatically

When you interact with the Services, we automatically receive:

  • Device information — device type, operating system, and unique device identifiers.
  • Log data — IP address, access times, and app activity logs.
  • Analytics data — aggregated usage patterns to help us improve the Services.

Purchase Information

If you make in-app purchases (subscriptions or minute top-ups), payment processing is handled entirely by Apple (App Store) or Google (Play Store). We receive confirmation of your purchase and entitlement details but do not collect or store your payment card information.

How We Use Your Information

We use the information we collect to:

  • Provide the Services — power real-time AI voice conversations, generate session summaries, track your learning progress, and personalise your tutoring experience.
  • Manage your account — authenticate you, maintain your profile and preferences, and track your usage quota.
  • Improve the Services — analyse usage patterns, diagnose technical issues, and develop new features.
  • Communicate with you — respond to support requests and send service-related notifications.
  • Ensure safety and compliance — detect and prevent fraud, abuse, or violations of our terms.

AI Processing and Third-Party AI Services

Our Services use OpenAI's APIs to power real-time voice conversations and to generate session summaries, mistake analysis, and learning memory. When you use the AI tutor:

  • Your voice input is transmitted to OpenAI via their Realtime API for processing and response generation.
  • Session transcripts may be processed by OpenAI's language models to generate summaries and extract learning insights.
  • OpenAI processes this data according to their API data usage policy, which states that data submitted through the API is not used to train their models.

Legal Bases for Processing

Where required by law, we rely on the following legal bases:

  • Contractual necessity — processing needed to provide the Services you have requested, such as creating your account and powering AI conversations.
  • Legitimate interests — improving the Services, ensuring security, and providing customer support, where these interests are not overridden by your rights.
  • Consent — where required by law, such as for certain types of data processing or marketing communications. You can withdraw consent at any time.
  • Legal compliance — processing necessary to comply with our legal obligations.

How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

  • AI service providers — OpenAI processes your voice and text data to provide the AI tutoring functionality, as described above.
  • Infrastructure providers — we use Amazon Web Services (AWS) to host and operate the Services. Your data is stored on AWS servers.
  • Authentication providers — Firebase (Google) provides authentication services.
  • Business transfers — in the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
  • Legal requirements — when required by law, regulation, or legal process, or to protect the rights, safety, or property of the Company, our users, or the public.
  • Aggregated data — we may share anonymised, aggregated data that cannot identify you for business analysis purposes.

Data Retention

We retain your personal data for as long as your account is active or as needed to provide the Services. Session transcripts, summaries, and learning memory are retained to support your ongoing learning progress. If you delete your account, we will delete or anonymise your personal data within 30 days, except where we are required to retain it for legal or regulatory purposes.

Data Security

We implement appropriate technical and organisational measures to protect your information, including encryption in transit (TLS) and at rest, access controls, and regular security reviews. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

Where Your Data Is Processed

The Company is based in the United Kingdom. Your data may be processed and stored in the United Kingdom, the European Economic Area, and the United States (for AI processing via OpenAI and infrastructure via AWS). Where data is transferred outside of your jurisdiction, we ensure appropriate safeguards are in place in accordance with applicable data protection laws.

Children

Our Services are not intended for children under the age of 13 (or the applicable age of digital consent in your jurisdiction). We do not knowingly collect personal information from children under this age. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at usespeakout@gmail.com and we will take steps to delete such information.

Your Rights and Choices

Depending on your location, you may have the following rights regarding your personal data:

  • Access — request a copy of the personal data we hold about you.
  • Correction — request correction of inaccurate or incomplete data.
  • Deletion — request deletion of your personal data.
  • Portability — request your data in a structured, machine-readable format.
  • Restriction — request that we limit processing of your data in certain circumstances.
  • Objection — object to processing based on legitimate interests.
  • Withdraw consent — where processing is based on consent, withdraw it at any time.

You also have the right to lodge a complaint with your local data protection supervisory authority.

California Residents

Under the California Consumer Privacy Act (CCPA), California residents have additional rights including the right to know what personal information is collected, request its deletion, and opt out of the sale of personal information. We do not sell personal information. To exercise your rights, contact us as described above.

The Services may contain links to third-party websites or services that are not operated by us. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you visit.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy within the App or on our website. Your continued use of the Services after such changes constitutes your acceptance of the updated policy.
